§1 Scope
These General Terms and Conditions (GTC) apply to all contracts between KEP-Consult GmbH (hereinafter "eSIMgo" or "we") and consumers as well as business customers (hereinafter "Customer" or "you") for the purchase of eSIM data packages via our website esimgo.app.
A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.
We do not recognize any deviating conditions of the customer unless we expressly agree to their validity in writing.

§3 Service Description
eSIMgo sells digital eSIM data products for mobile internet use abroad. The eSIM profiles are provided by our technical partner Yesim (Genesis Group AG, Switzerland) and enable the use of mobile networks from various partner network operators worldwide.
Network coverage and quality depend on the respective local network operators. eSIMgo is a reseller and not a network operator itself. Information about available networks and coverage can be found on the respective product page.
To use an eSIM, you need a compatible, SIM-lock-free device. A list of compatible devices can be found on our website under "Supported Devices".
§4 Contract Conclusion
The presentation of products on our website does not constitute a legally binding offer, but an invitation to order (invitatio ad offerendum).
By clicking the "Buy Now" button, you place a binding order for the products in the shopping cart. Confirmation of receipt of your order will be sent immediately after submission by email.
The contract is concluded when we accept your order by sending the eSIM activation data (QR code) by email.
§5 Prices and Payment
All prices quoted are final prices and include the statutory Austrian VAT of 20%. There are no additional shipping costs as these are digital products.
Payment is made by credit card (Visa, Mastercard), PayPal or Apple Pay. Your payment method will be charged immediately after completing the order.
Net prices and invoicing can be offered to business customers upon request.
§6 Delivery
After successful payment, you will receive the eSIM activation data (QR code and installation instructions) immediately in two ways: by email to the address provided during the order and in your personal dashboard on our website.
Delivery is exclusively digital. No physical products are shipped.
Please ensure that you provide a valid email address and check your spam folder if necessary.
§7 Right of Withdrawal
As a consumer, you generally have a 14-day right of withdrawal. The complete withdrawal instructions and the sample withdrawal form can be found on our "Right of Withdrawal" page.
Important notice for digital content:
Since eSIM data packages are digital content not supplied on a tangible medium, your right of withdrawal expires prematurely if you have expressly consented before the expiry of the withdrawal period that we begin the execution of the contract, and you have confirmed your knowledge that you lose your right of withdrawal by consenting to the beginning of the execution of the contract. You give this consent in the ordering process by activating the corresponding checkbox.
§8 Warranty and Liability
The statutory warranty rights apply. For digital products, we guarantee that the product meets the agreed requirements when provided.
eSIMgo is fully liable for damages arising from injury to life, body or health as well as for damages caused intentionally or through gross negligence.
The respective network operators are responsible for the quality, availability and speed of the mobile networks. eSIMgo does not assume any warranty or liability for this.
The eSIM infrastructure and services are provided by our technical partner Yesim (Genesis Group AG). We are only liable for technical disruptions on the part of the service provider within the scope of our influence.

§10 Final Provisions
Austrian law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as mandatory provisions of the law of the country in which the consumer has their habitual residence do not provide greater protection.
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
